Criminal Law & Process
Marek Hamlin and his team specialises in representing people who are charged with criminal offences. They regularly successfully defend individuals charged with a range of offences, from minor to extremely serious matters.
Violence Related Offences
If a person has been charged with a violence-related offence of any kind, we can assist. Common violence-related offences include assault on a person in a family relationship, common assault, male assaults female, threatening to kill, assault with a weapon and assault with intent to injure​.​
Fraud Charges
Marek regularly deals with fraud-related offending and has significant experience in police and Ministry of Social Development investigations. Fraud charges are usually complex and can be alleged to occur over significant offending periods requiring attention to detail and thorough analysis. Whether this requires further expert and forensic advice and investigation will depend on the scale of the case.
Traffic Law
If charged with an offence under the Land Transport Act 1998, such as drink driving, careless or dangerous driving, or driving without an appropriate licence, we can help. We have a track record of success in representing individuals charged with these offences and can help to get you back on the road as soon as possible.
Drug Related Offences
We have extensive experience in dealing with drug-related offending. There are a wide range of approaches to address drug charges, such as assessing police procedures and challenging the validity of the search, ensuring appropriate drug testing procedures were followed, and challenging the quantum and purity of any substance found.
Parole, Recall & Corrections Charges
Marek has an extensive track record of successfully achieving release on parole and arguing against recall applications. The Department of Corrections can prosecute people for breaching established conditions or sentences. If you are facing a breach, you need the right help and guidance to safely deal with Corrections and the Court process.
Extended Supervision Orders
The Department of Corrections can apply for extended conditions including extended supervision orders (“ESO”) for eligible people. Marek is very experienced in negotiating and opposing such applications and conditions in both the High and District Courts and before the New Zealand Parole Board.
Appeals
Appeals in the field of criminal law can relate to trial issues, applications (including bail), convictions and/or sentences, ESOs and Parole. Where a judge, jury or other authority makes the wrong decision, the only way to correct these errors is through appeal.
